The petitioner seeks bail in Amdabad P.S. Case No. 19 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, on 14.01.2020 the informant after withdrawing Rs. 7,00,000/- from the bank while returning to his home, on the way, three unknown miscreants stopped him and looted his bag containing cash, Adhar card, PAN card etc. and fled away.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated. Petitioner is not named in the FIR. Name of petitioner surfaced on certain secret information received by the police. Chargesheet has already

Patna High Court CR. MISC. No.35575 of 2020(3) dt.29-01-2021 2/2 been submitted. Petitioner is in custody since 25.06.2020 having no criminal antecedent.

Learned APP however, vehemently opposed the prayer for bail and submitted that it has come in para 62 and 63 of case diary that looted articles has been recovered from the house of petitioner.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
