JUSTICE MADHURESH PRASAD ORAL ORDER 01-06-2017 Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in Dariyapur P. S. Case No. 23 of 2017 registered for the offences under Sections 341, 323, 324, 307, 385, 506 and 34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that prior to the lodging of the instant case on 08.02.2017, the petitioner had lodged an F.I.R. against the informant of the instant case bearing Dariyapur P.S. Case No. 22 of 2017 on 04.02.2017. It is further submitted that the instant F.I.R. is a counter blast to the said case. It is also submitted that the petitioner is a man of clean antecedent.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.24413 of 2017 (2) dt.01-06-2017 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Dariyapur P. S. Case No. 23 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
