2. The petitioner seeks bail in connection with S.Tr. No. 622/2025 arising out of Sultanganj P.S. Case No. 343/2024 registered for the offences under Section 103(1)/3(5) of B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution story, the informant's husband was threatened by some persons who demanded Rs. 10 lakhs as extortion money. It has been stated that due to nonfulfillment of such extortion amount, he was killed. It has been stated by the informant that altogether eight persons were involved in the said crime.

4. Learned counsel for the petitioner submits that

No.35821 of 2025(2) dt.29-05-2025 2/3 petitioner is not named in the FIR and his name was stated by the spy alleging that he was in contact with one of the accused namely Kranti Dubey, who happens to be the linchpin in the said incident. Learned counsel further submits that till date no TIP has been conducted and there is nothing on record to connect the petitioner with the present incident. It is lastly submitted that the petitioner has clean antecedent and is in custody since 15.09.2024.

5. Learned APP for the State has opposed the prayer for bail of the petitioner and submits that the petitioner was part of the gang and had committed murder of the informant's husband.

Considering the aforesaid facts and circumstances of the case and taking into account that the person with whom the petitioner is alleged to have been in contact has already been granted anticipatory bail by a Co-ordinate Bench of this Court and taking into account the period of custody, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Patna City in connection with S.Tr. No. 622/2025 arising out of Sultanganj P.S. Case No. 343/2024

Patna High Court CR. MISC. No.35821 of 2025(2) dt.29-05-2025 3/3 subject to the conditions :- a. One of the bailors of the petitioner shall be his close relative.

b. The petitioner shall remain physically present in Court on each date of the trial.

c. In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to the cancelled by the court concerned.

d. The Court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the aforementioned order shall not be delayed for purpose of or in the name of verification.
