2. Petitioners seeks bail where petitioner nos. 1 and 2 are in custody since 06.02.2026 and petitioner no. 3 is in custody since 24.03.2026 in connection with Laheri P.S. Case No. 558 of 2025, F.I.R. dated 16.12.2025 for the offences punishable under Sections 8(c) and 21(b) of the N.D.P.S. Act.

3. Recovery is of 39 grams 740 miligrams of brown sugar like substance.

4. Learned counsel for the petitioners submits that petitioner nos. 2 and 3 have no criminal antecedent and

No.36888 of 2026(2) dt.16-06-2026 2/3 petitioner no. 1 carries one criminal antecedent other than the present one but he is on bail in the pending matter and they have falsely been implicated in the present case. He further submits that it appears from the F.I.R. as well as seizure list that no incriminating articles have been recovered from the conscious possession of the petitioners and they have been made accused merely on the basis of suspicion and the recovery has been made from the co-accused, namely, Bhola Chaudhary. Petitioner nos. 1 and 2 are in custody since 06.02.2026 and petitioner no. 3 is in custody since 24.03.2026.

5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioners.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Principal Sessions Judge-cum-Special Judge, Nalanda at Bihar Sharif in connection with Laheri P.S. Case No. 558 of 2025, subject to the following conditions:- i. Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court

Patna High Court CR. MISC. No.36888 of 2026(2) dt.16-06-2026 3/3 and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below.

ii. If the petitioners tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

iii. And further condition that the court below shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
