2. The petitioner has preferred this application for grant of regular bail in connection with S.Tr. No. 18 of 2025 arising out of Bathnaha P.S. Case No. 248 of 2020 dated 29.10.2020 registered for the offences punishable u/s 302, 120(B)/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and other co-accused persons armed with swords came to the house of the informant and assaulted the mother of the informant causing her death. The occurrence took place in the background of dispute over right to way and kidnapping of the sister of the informant.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.36355 of 2025(2) dt.23-06-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner is named in the FIR. It is submitted that allegation is made against co-accused Raju Sharma that of catching hold the hand of Kajal Kumari the sister of informant and that of dragging her out, the petitioner is not there. There is no eye witness to the alleged occurrence. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. Similarly situated co-accused person has already been granted bail by the co-ordinate bench of this Court vide order dated 13.12.2024 passed in Cr. Misc. No. of 54222 of 2024. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 09.05.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, in connection with S. Tr. No. 18 of 2025 arising out of Bathnaha P.S. Case No. 248 of 2020.
