JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

As per the prosecution case, petitioner and other accused persons entered the house of the informant, locked the informant and others in a room and assaulted her mother and strangulated her to death.

Learned counsel for the petitioner submits that the instant case is counter blast of Rafiganj Police Station Case No. 189 of 2012 in which husband of the informant and other accused persons had been convicted for life imprisonment. It is submitted that the informant herself has killed her mother for grabbing the entire amount of consideration money received by

There is general and omnibus allegation of assault against all the accused persons and no specific overt has been alleged against the petitioner. Similarly situated coaccused has already been allowed bail by a co-ordinate bench of this Court vide Annexure 3. Petitioner is in custody since 16.1.2021.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sherghatti, Gaya in Gurua Police Station Case No. 48 of 2015.
