The petitioners are apprehending their arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 379 of the Indian Penal Code and 3(I)(X) of the S.C./S.T.(Prevention of Atrocities) Act.
It is alleged that the petitioners entered in the courtyard of the informant and assaulted her by calling caste name and pulled her sari.
It is submitted by the learned counsel for the petitioners that admittedly the occurrence took place in the
Patna High Court Cr.Misc. No.8708 of 2015 (2) dt.02-03-2015 courtyard of the informant which is not the public place and in the background of land dispute accusation has been levelled, but the occurrence of 03.04.2013 the complaint was filed on 05.04.2013.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera, Samastipur in connection with C.R. Case No. 252 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
