Learned counsel for the petitioner is directed to remove the defects, as pointed out by the Office, within a period of four weeks.
The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506 and 406 of the Indian Penal Code.
The prosecution allegation, in short, is that the accused person assaulted the informant due to which he sustained injuries.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no
Patna High Court CR. MISC. No.34292 of 2020(2) dt.22-03-2021 2/2 allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The injury report does not bear the nature of injury caused by the petitioner. In absence of such finding, it cannot be ascertained whether offence under Section 307 I.P.C. is made out or not. As per the allegation, at best it is a case for offence under section 325 I.P.C.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S. Case No. 185/2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
