The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 147, 148 and 149 of the Indian Penal Code As per the prosecution case, the six named accused persons including the petitioner herein assaulted the father of the informant. It is further stated that Anil Yadav and Shiv Kumar Yadav with an iron rod proceeded to assault even after the informant's father fell down and lost consciousness. The father of the informant was taken to the N.M.C.H where he died in course of treatment.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.47901 of 2021(2) dt.09-02-2022 2/2 that the petitioner has been falsely implicated in the case. The specific allegations of assault is against Anil Yadav and Shiv Kumar Yadav. The allegations against the petitioner is general and omnibus in nature and similar to that of Gautam Kumar, Indrajeet Yadv and Baban Yadav who have been enlarged on bail vide order dated 22.11.2021 passed in Cr. Misc. no. 47963 of 2021. The petitioner is in custody since 8.4.2021 and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for more than 10 months and grant of bail to the above named co-accused, the Court directs the petitioner to be enlarged on bail in connection with Salimpur P.S. Case no. 54 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Barh, District Patna.
