The petitioner being the husband of the complainant is apprehending arrest in a complaint case in which process were directed to be issued after cognizance being taken under sections 498A, , 406, 323 of the Indian Penal Code and 4 of the D.P.Act.
The basic accusation is of torture for non fulfillment of dowry demands. On instruction the learned counsel for the petitioner submits that petitioner is ready to keep the complainant with all dignity and honour. A statement to this
Patna High Court Cr.Misc. No.6117 of 2015 (4) dt.07-08-2015 2/2 effect has been made in paragraph 16 of the petitioner which reads as follows:
"That the petitioner is still ready to keep the complainant as a wife with full dignity and honour." Counsel for the complainant submits that complainant is ready to accept the offer of the petitioner. Both sides agree to appear before the court below on 24.08.2015from where the petitioner will take the complainant to keep her with dignity and honour.
Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Siwan in Complaint Case No. 1165 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
