The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code and Section 10 of the Bihar School Examination Act.
It is alleged that the petitioner authorized one Rajiv Kumar co-accused to appear in the examination of Railway Group -D/Railway Recruitment Cell in his place. It is submitted by learned counsel for the petitioner that petitioner has no knowledge about Rajiv Kumar appearing in his place and even assuming the accusation, no case under section 419 of the Indian Penal Code is made out. It is further submitted that non-grant of bail to the petitioner will jeopardize
Patna High Court Cr.Misc. No.13929 of 2015 (2) dt.03-04-2015 2/2 his career.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Gaya Civil Line P.S. Case No.602 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bonds of the petitioner shall be accepted by learned court below on filing affidavit by the petitioner to the effect that he will regularly co-operate during investigation. Non-cooperation of the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner. (Dinesh Kumar Singh, J) Ashwini/- U T
