The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 465, 467, 468, 471, 419 and 420/34 of the Indian Penal Code. It is alleged that the petitioner got a sale deed executed with regard to the land by misleading the mother of the informant.

It is submitted by the learned counsel for the petitioner that the sale deed was executed on 10.09.2001. The mother of the informant never raised any objection. On the basis of sale deed executed in 2001 mutation was done in favour of the petitioner. Title Suit No. 1228 of 2013 was filed with regard to the same land by Samser Ali Khan in which the

Patna High Court Cr.Misc. No.6185 of 2015 (2) dt.16-02-2015 petitioner is defendant.

Considering the sale deed executed in 2001 whereas the present case has been lodged in 2014, the mother of the informant who executed the sale deed has never raised any objection, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 286 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
