JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-05-2016 Heard learned counsel for the petitioners and the learned Addl. Public Prosecutor, appearing on behalf of the State. This application for grant of anticipatory bail arises out of Azimabad P.S.Case No. 68/2015, disclosing offences under sections 147, 148, 149, 341, 354 of the Indian Penal Code and sectin 3(x)(xi) of the SC/ST Act and section 27 of the Arms Act. Allegations made in the first Information Report constitute offence under section 3(x)(xi) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. Considering the bar under section 18 of the said Act, this application for anticipatory bail cannot be entertained.

This application is, accordingly, dismissed.

No.18967 of 2016 (2) dt.09-05-2016 However, considering the nature of allegation and the dispute between the parties, it is directed that if the petitioners surrender before the court below within four weeks from today and seek regular bail, their application for regular bail shall be disposed of on the same day.
