The petitioner is in custody in connection with Amas P.S. Case No. 63 of 2002 for the offences under Sections 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 01.03.2019. He further submits that petitioner was not named in the F.I.R. and the name of the petitioner surfaced on confessional statement of co-accused Chandarik Chaudhary. He further submits that nothing was recovered from the conscious possession of the petitioner.
Considering the fact that the case was registered in the
Patna High Court CR. MISC. No.35094 of 2019(2) dt.28-05-2019 2/2 year 2002 and petitioner has remained in custody for more than two months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Judicial Magistrate, 1st Class, Sherghati, Gaya in connection with Amas P.S. Case No. 63 of 2002. with the condition that the petitioner shall extend full cooperation in conclusion of trial, if he fails to do so liberty shall be available to the Trial Court to cancel his bail bond.
