KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 20-02-2020 The present petition was registered Suo Motu on the basis of communication dated 05.05.2018. The note prepared by the Registry is as under:

"PUC is the letter of Professor Ratnagiri Mishra, resident of CDA Colony, Shastrinagar, Patna sent to Hon'ble Dr. Justice Anil Kumar Upadhyay by post submitting his grievance arising from the construction of multistoried building in front of house number 130 and 145 in road number 8B which is only 13 feet wide in CDA Colony road in Shastrinagar, Patna.

According to him on account of dumping of building material in large quantity the road has become blocked followed by water logging, making the area almost inhabitable by local people but despite complaints to the District Magistrate and supdt. Of Police, nothing

In view of the above said facts and the observation of the Hon'ble Bench, matter is being placed before your Lordship for kind perusal and necessary order or for passing any other order or orders as your Lordship may deem fit and proper."

We are in agreement with the learned counsel for the petitioner that with the passage of time the present petition has become infructuous inasmuch as there is no water logging in the area. But perhaps it could not be appropriate for this Court to examine the suitability of the construction which may result into the water logging and in any event at this point of time there is no water logging.

As such, we close this proceeding reserving liberty to any public spirited person to approach the Court if any illegal action perpetuates. We are hopeful that if such request is sought then that shall be considered.
