The petitioner seeks bail in anticipation of his arrest in connection with Lalganj P.S. Case No. 149/2020 instituted for the offences under Sections 302, 201/34 of the Indian Penal Code.

It is submitted that the petitioner is the cousin of the husband of the deceased. For the aforesaid reason, case diary was called for by order dated 05.04.2021 and the petitioner was granted provisional bail.

Learned counsel for the petitioner has submitted that he is separate in mess and business from the husband of the

Patna High Court CR. MISC. No.36060 of 2020(4) dt.21-06-2021 2/2 deceased for the last several years and only because he happens to be related to the family, he has been made accused in this case. Nothing specific has been attributed against him and since the petitioner does not stay under the same roof where the deceased had stayed, there is practically no reason why the petitioner would trouble the deceased for non fulfillment of dowry demand.

Considering the afore-stated facts, the provisional bail granted to the petitioner is hereby confirmed. The petitioner shall remain on the same bail bonds. The application stands allowed.
