JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 420, 188, 120(B) of the Indian Penal Code, u/s 52/53 of Disaster Management Act, u/s 3 of Epidemic Disaster Act, u/s 7 of E.C. Act and u/s 28/36 of Drugs and Cosmetic Act.

As per the prosecution case, on secret information that some miscreants are illegally selling life saving Remdesivir injection on exorbitant price a raid was conducted and this petitioner along with two other accused persons were apprehended and from them Rs. 1,20,000/- cash has been recovered.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.47643 of 2021(2) dt.22-11-2021 2/2 that petitioner is innocent and has falsely been implicated in the case. No incriminating article or medicine has been recovered from the conscious possession of the petitioner and only on suspicion petitioner has been made accused in this case and in support of his learned counsel referred to seizure list. Petitioner claims clean antecedent and is in custody since09.05.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, Patna in connection with Kankarbagh PS case No. 458/2021.
