In the present case, petitioner has been compelled to approach this Court for payment of admitted amount of Rs. 8, 67,138/-.

It has been claimed that petitioner was awarded work for construction of road from Kharhaa to Gurudrdwara Road under Banka Division and for that petitioner had entered into an agreement for work value at Rs.2,11,36,007. Petitioner was paid time to time and ultimately by way of final payment the

Patna High Court CWJC No.8714 of 2017 dt.26-07-2017 Executive Engineer, Rural Work Department, Works Division, Banka has issued a cheque amounting to Rs.8,67,138/-, petitioner deposited the said cheque in Bank which was returned showing insufficient fund in the account.

It is a very serious matter that the cheque handed over by the authority of the State Government was dishonoured due to insufficient fund. It creates senses of in security to a person who accepts the cheques.

In such view of the matter, the Principal Secretary, Rural Work Department, Government of Bihar, Patna is directed to look into the matter and ensure payment of Rs. 8,67,138/- within a period of three weeks from the date of receipt/production of a copy of this order.

With the aforesaid observation this writ petition is disposed of.
