The present application has been filed for modification of the order dated 16.4.2015 passed in Cr. Misc. No.46230 of 2014 to the extent of extending the period of surrender. The petitioner was granted anticipatory bail vide Cr. Misc. No. 44707 of 2009 and the petitioner was to execute the bail bond within a period of one month. The said order was modified vide order dated 8.5.2013 passed in Cr. Misc. No. 20412 of 2013 whereby the period of surrender and executing the bail bond was extended by further one month. Thereafter, the petitioner again preferred Cr. Misc. No. 46230 of 2014 for extending the period of surrender on the ground of illness of the petitioner which was disposed of vide order dated 16.4.2015

Patna High Court CR. MISC. No.45246 of 2019(2) dt.31-07-2019 2/2 with a liberty to the learned Court below to consider the prayer of the petitioner for regular bail keeping in view the fact that the petitioner was granted anticipatory bail on merit, in case he surrenders within six weeks, but the petitioner did not surrender or prayed for regular bail.

Since similar prayer has been rejected earlier, this Court is not inclined to interfere.

This application is, accordingly, dismissed.
