JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-04-2016 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 379, 498A, 364 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

The prosecution case is that the sister of the informant was married with the petitioner on 30.04.2014 but subsequently demand of dowry of Rs. 3 lacs were made. The petitioner subsequently sold the sister of the informant to one Ajit Ram. In 164 Cr.P.C statement the victim stated that Ajit Ram ravished her and she was sold to Ajit Ram by her husband.

It is submitted by learned counsel for the petitioner that in the trial of Ajit Ram, the victim, sister of the informant has admitted that Ajit Ram enticed her away to Delhi. It is further submitted that the marriage between the

Mr. Surya Narayan Yadav, learned counsel appearing on behalf of the informant submits that the marriage has been dissolved and the informant is not opposing the prayer for anticipatory bail of the petitioner. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runni Saidpur P.S. Case No. 62 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
