The petitioner is languishing in custody for the offences punishable under Sections 406/417/418 /419 /420 / 465/466/467/468/469/471/120B of the Indian Penal Code. According to FIR, the police raided a flat and found the FIR named accused persons including the petitioner. Allegation is that the accused persons were involved in cheating different innocent persons on the pretext of their admission in Medical and Engineering Colleges.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. There is no substantial material against the petitioner regarding involvement in the act alleged. He is in custody since 09.08.2020.
Patna High Court CR. MISC. No.33767 of 2020(3) dt.22-01-2021 2/2 Investigation of the case is already complete. Considering the facts of this case aforesaid, let the petitioner, above named, be released on bail after framing of the charges so that the trial may not hamper on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Buddha Colony P.S. Case No.206 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
