The petitioners apprehend their arrest in Chhatapur P.S. Case No. 183 of 2013, registered under Section 307 and other sections of the Indian Penal Code.

Learned counsel for the petitioners submits that earlier the case was lodged under Section 324 and other sections of the Indian Penal Code. The petitioners were granted bail by the learned court below but the police, after investigation, submitted chargesheet under Section 307 IPC and thereafter cognizance was taken.

It appears that the petitioners were granted bail during the investigation and he shall be deemed to be on bail even after passing of the order taking cognizance unless his bail bonds

Patna High Court Cr.Misc. No.33030 of 2014 (2) dt.09-02-2015 2/2 are cancelled in accordance with law.

Considering the facts aforesaid, the anticipatory bail is not maintainable. Accordingly, the same is dismissed. (Prabhat Kumar Jha, J) Dilip/- U T
