JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 01-07-2015 Heard learned counsel for the petitioners and the State. The petitioner is apprehending his arrest in connection with Khajauli PS case No. 177/2012 for the offence under section 147, 148, 149, 452, 380, 353 and 427 of the Indian Penal Code. According to prosecution, a mob consisting several persons entered into godown and looted articles kept therein whereby huge loss was sustained by the State. The informant is Assistant Manager of the godown owned by Bihar State Food Corporation.

It has been submitted that no recovery of the looted article has been made from the possession of the petitioner. The petitioner is not named in the FIR.

Learned Additional Public Prosecutor, on the other hand, on going through the case diary, states that witnesses have

Patna High Court Cr.Misc. No.6196 of 2015 (4) dt.01-07-2015 2/2 identified the petitioner amongst several others, who constituted the mob. From records, it appears that several accused of this case have been granted regular bail.

Considering the allegation and the material reflected from the case diary, I am not inclined to extend the privilege of anticipatory bail to the petitioner. The prayer is refused. In case the petitioner, above named, surrenders and prays for regular bail before the learned Shri Subir Kumar, J. M. 1st class, Madhubani in connection with Khajuali PS case No. 177 of 2012, the same shall be considered and disposed of on its own merit uninfluenced in any manner by the present order.
