Heard learned counsel for the petitioner, learned counsel for the victim as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mokama P. S. case no. 161/2012 registered under section 366A/34 of the IPC. The statement of victim has not been recorded by the Investigating officer in course of investigation but before this court, victim, specifically, stated that she has solemnized her marriage with the petitioner and after marriage, she gave birth to a child out of the aforesaid wedlock.

Considering the aforesaid statement of the victim as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs
