Heard learned counsel for the petitioners and the learned APP for the State.
At the outset, learned counsel for the petitioners has submitted that during pendency of the anticipatory bail petition, petitioner no.1 Rajesh Kumar has been arrested. He, therefore, seeks permission to withdraw the application as against petitioner no.1.
Permission is accorded. The application is accordingly dismissed as having become infructousas against
Patna High Court CR. MISC. No.47695 of 2021(2) dt.17-05-2022 2/2 petitioner no.1.
So far as petitioner no.2 is concerned, allegation is general and omnibus and injuries are simple in nature. Considering the above mentioned facts and circumstances, the petitioner no.2 Nitesh Kumar, in the event of arrest or surrender within four weeks from today, is directed to be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate I, Nalanda at Biharsharif in connection with Giriak P.S. Case no. 86 of 2021 subject to condition as laid down under section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court.
