====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 16-06-2025 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with S.T. No. 50 of 2025 (arising out of Pratapganj P.S. Case No. 206/2024) dated 19.11.2024 registered for the offence punishable u/s 126(2), 115(2), 352, 109, 351(2) and 351(3) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons in connivance with one another are alleged to have abused and assaulted the informant. Thereafter, the petitioner slit the right ear of the informant and the co-accused

Patna High Court CR. MISC. No.35678 of 2025(2) dt.16-06-2025 2/3 Sanjeet Das assaulted him on the head with an iron rod, causing head injury. Further, the co-accused Ram Lakhan Das assaulted the informant with mercury on his eye causing injury.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. There is a delay of 10 days in lodging the F.I.R. Learned counsel has submitted that charge has been framed on 11.03.2025 but till date out of six charge-sheet witnesses only one witness has been examined. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.01.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the specific allegation is against the petitioner. As per Annexure-2, there is permanent removal of right ear pinna. As per the injury report, all the three injuries are grievous in nature caused by hard and sharp weapon.

6. Considering the aforesaid facts and circumstances of the case as well as the specific nature of allegation against the petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with S.T. No. 50 of 2025 (arising out of Pratapganj P.S. Case No. 206/2024) pending in the court of learned District and Sessions Judge-IV, Supaul.

7. Learned court below is directed to expedite the trial and conclude the same within 9 months.
