The petitioner apprehends his arrest in a case under Section 307 and other sections of the Indian Penal Code. The petitioner is alleged to have assaulted the informant with Gadasa on his head. Rajdeo Yadav and Ram Babu Yadav are alleged to have assaulted the informant with Lathi. The accused persons also assaulted Anita Devi.
It is submitted that there is case and counter case and Ram Babu Yadav, brother of petitioner, is informant of Jainagar P.S. case No. 183 of 2015 in which from the side of petitioner many persons got injuries. The injury received by the informant, Suresh Yadav, on his head has been opined by the doctor to be simple in nature (annexure-3).

No.16038 of 2016 (2) dt.01-07-2016 2/2 Having considered the fact that there is case and counter case and both sides are co-sharer, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Madhubani in Jay Nagar P.S. Case No. 184 of 2015 (G.R. No. 2206 of 2015), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
