The petitioner is languishing in custody since 06-03-2019 in a case registered for the offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case is that from the possession of the petitioner, 5 litres 400ml Indian Made Foreign Liquor was recovered.

It is submitted by learned counsel for the petitioner that though the petitioner is accused in two other cases under the Excise Act, but he is on bail in those cases. Learned APP submits that recovery has been made from the possession of the petitioner.

Considering the nature of recovery and the period

Patna High Court CR. MISC. No.34677 of 2019(2) dt.28-05-2019 2/2 under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah in connection with Rail Narkatiaganj P.S. Case No. 22 of 2019.

The learned Court below will be at liberty to cancel the bail bonds of the petitioner in case he substantially gets involved in similar nature of offence.
