JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2020 Heard Mr. Ajay Kumar Thakur, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Bhadaur P.S. Case No. 59 of 2020, dated 07.06.2020, instituted for the offences under Sections 447, 341, 323, 324, 326, 307, 302, 504, 506 and 34 of the Indian Penal Code.

It has been alleged in the F.I.R. that when a

No.33512 of 2020(2) dt.16-12-2020 2/3 protest was raised against the accused persons for having caused obstruction in the passage by dumping cow dung, the accused persons are said to have assaulted the husband and sons of the informant. The specific act of assault has been attributed to the two sons of the petitioner. So far as the petitioner is concerned, she is said to have pinned down the informant on the ground, which prevented her from rescuing her husband.

Learned counsel for the petitioner has submitted that the parties are agnates and the dispute arose out of a trifle. The petitioner is not alleged to have caused any injury on the deceased. She is only said to have prevented the informant from protecting her husband, who ultimately died of the injuries suffered by him in the transaction. The petitioner is in custody since 09.06.2020. Regard being had to the gender of the petitioner as also her period of custody, she is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist
