2.The petitioner is named in the F.I.R. and apprehending his arrest in connection with Amba P.S. Case No. 146 of 2023 registered for the offences punishable under Sections 376, 313 of IPC.

As per FIR petitioner and informant both are of different religion and were in love, out of which informant changed her religion and married petitioner, but after few years she was ousted and deserted by the petitioner. It is also alleged that informant was forced to terminate her pregnancy four times.

4. Countering aforesaid allegation, learned counsel

Patna High Court CR. MISC. No.36707 of 2026(2) dt.16-06-2026 2/3 appearing on behalf of the petitioner referred para no. 111 of the case diary where re-statement of informant namely, Choti Gupta @ Sajiya Praveen was recorded, where she stated that out of love she solemnized marriage with petitioner in the year 2022. She didn't said anything about change of religion and when after sometime petitioner deserted her she was also not accepted by her parents, therefore, she out of her own sweet will married with another person where she was blessed with one child. It is also submitted that no alleged photograph and videograph was given by her to police, as all such things was deleted by her. She is also silent about forceful termination of her multiple pregnancy as alleged through FIR. Petitioner claimed clean antecedent.

5. Learned APP opposes the prayer of bail.

6. In view of aforesaid factual submission and by taking note of re-statement of informant where she primafacie negated allegation of miscarriage and also capturing of obscene videos and photograph all alleged through FIR, rather she stated that she out of her sweet will married one

No.36707 of 2026(2) dt.16-06-2026 3/3 another person, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Addl. Sessions Judge 1st cum Spl. Judge NDPS and Children Act, Aurangabad /concerned Court, where the case is pending in connection with Amba P.S. Case No. 146 of 2023, subject to the conditions as laid down under Section 482(2) of BNSS.
