2. The petitioner seeks bail in connection with Bihta P.S. Case No. 383 of 2024 registered for the offence under Sections 304(B), 201, 34 of the Indian Penal Code and under Sections 3⁄4 of the D.P. Act.

3. As per the prosecution case, the petitioner is the husband of the deceased and he is alleged to have killed the deceased.

4. The petitioner is in custody since 3.7.2024.

5. From the post-mortem report, it does not appear that the deceased was assaulted before her death as no antemortem injury was found on the body of the deceased and it appears that she had committed suicide.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Danapur, Patna/concerned Court below in connection with Bihta P.S. Case No. 383 of 2024.

8. After being released on bail, the petitioner is directed to cooperate in the trial by appearing personally till the framing of charge, if the charge has not already been framed and after framing of charge he is directed to cooperate in the trial either by appearing personally or through his lawyer. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
