JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-11-2021 The present writ petition has been filed for directing the respondents to issue PDS license on compassionate ground in the name of the petitioner.

The learned counsel for the petitioner has submitted that the grandfather of the petitioner was running a PDS shop and after his death, the petitioner had applied for grant of license of PDS shop on compassionate ground since his father had already died before the death of his grandfather. Patna High Court CWJC No.289 of 2021(3) dt.01-11-2021 2/3 stated to have been conducted by the district officials and the case of the petitioner has been found suitable for grant of PDS license on compassionate ground and the licensing authority has also recommended the name of the petitioner to the District Level Selection Committee for issuance of license in the name of the petitioner on compassionate ground. It is also submitted that though the District Level Selection Committee, headed by the District Magistrate, Patna, has already taken a decision to appoint the petitioner as a PDS dealer, but the final order is not being issued.

Having regard to the facts and circumstances of the case, the present writ petition stands disposed of as not pressed with liberty to the petitioner to file appropriate representation before the District Magistrate, Patna regarding his aforesaid grievances and in case, such a representation is filed within a period of four weeks from today, the same shall be disposed of by a reasoned and a speaking order within a period of
