JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Special Case No. 07 of 2012, arising out of Bhabhua P.S. Case No. 533 of 2011, registered under Sections 420, 409, 467, 468, 471/34 and 120B of the Indian Penal Code and Section 13(1)(D) of the Prevention of Corruption Act. The accusation is that in course of investigation, it was detected that Rs.11,22,000/- was given to Sanjaivini Hospital and Research Centre, Mohania, which was being run by this petitioner under the family planning scheme and other schemes by the office of Civil Surgeon, Kaimur at Bhabhua, but in audit, only

Rs.7,12,500/- was found utilized and rest amount is said to be miss-appropriated by the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case with ulterior motive. Moreover, the petitioner is ready to deposit the defalcated amount of Rs.4,10,000/- in the concerned department on protest within three months.

Having regard to the facts and circumstances of the case and submission of learned counsel for the petitioner, let the above named petitioner be released on provisional bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance I, Patna, in connection with Special Case No. 07 of 2012, arising out of Bhabhua P.S. Case No. 533 of 2011, subject to the condition as laid down under Section 438(2) of the Cr.P.C. If the petitioner submits the receipt regarding depositing of Rs.4,10,000/- within three months in favour of concerned department, the provisional bail of the petitioner shall be confirmed by the court below. If the petitioner fails to submit the receipt of showing the deposit of Rs.4,10,000/-, the court below will be at liberty to cancel his bail

bond.

Accordingly, the application is disposed of.
