The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 337, 338 and 427 of the Indian Penal Code.

The prosecution case in short is that on 14.02.2019 at about 7.30 AM Ravi Kumar, Aman Kumar, Niraj Kumar, Sarvan Ram, Nitu Kumari, Nishu Kumari and Devanti Devi up-staired upon their ceiling and started trowing bricks causing damage of his asbestos and loss of Rs.15000/-. Ravi Kumar assaulted by lathi and rod to his son Rajan Kumar causing head injury. When Gudiya Kumari, Atul Kumar rushed to save Ravi Kumar assaulted them by lathi also.

Petitioner is having clean antecedent. Considering the facts aforesaid, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan/successor Court in connection with Siwan Mufassil P.S. Case No. 72 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
