The petitioners, five in number, apprehend their arrest in Sheikhpura SC & ST P.S. Case No. 11/15 registered under Sections 147, 148, 341, 323, 325, 354(A), 504 of the Indian Penal Code and Section 3(R)(S)W(ii) of SC and ST Act. The informant alleged that the accused persons asked him to vacant the land, on such, the petitioners are alleged to have assaulted the informant with lathi on his head and when his wife came to rescue him, Sachchidanand Singh (petitioner no. 3) assaulted his wife also. It is submitted that there is a counterversion being Jairampur P.S. Case No. 18/15. The informant wanted to grab the land of the petitioners and, that is why, this
Patna High Court Cr.Misc. No.15378 of 2016 (3) dt.30-06-2016 2/2 false case has been lodged. The injuries found on the person of the informant and his wife are simple in nature.
Learned A.P.P. has opposed the prayer for anticipatory bail but fairly submitted that the injuries found on the person of the injured are simple in nature.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in Sheikhpura SC & ST P.S. Case No. 11/15, G.R. No. 396/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
