JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-03-2015 Heard learned counsels for the petitioner and the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504 of the Indian Penal Code and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act. It is alleged by the informant being under raiyat of petitioner that when the informant informed the petitioner about water motor pump being washed away due to landslide the petitioner assaulted the informant and abused by calling caste name.

It is submitted by learned counsel for the petitioner that the informant was not medically examined as there is no injury report on the record

Patna High Court Cr.Misc. No.33868 of 2014 (2) dt.20-03-2015 2 / 2 and admittedly the informant being under raiyat of petitioner with ulterior motive has lodged the present case and for occurrence of 07.07.2014, F.I.R. was registered on 08.07.2014 which reached to the learned court below on 10.07.2014 which suggests that antedating has been done in registering the F.I.R. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with SC/ST P.S. Case No. 50 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
