JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-03-2021 Heard Mr. Shyameshwar Kumar Singh, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Vaishali P. S. Case No. 461 of 2019, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

840.6 litres of liquor is said to have been recovered from a dilapidated room by the side of the community centre which is said to belong to one Rajendra Rai. The place from where recovery has been made is not inhabited by anyone of the family members of the aforesaid Rajendra Rai.

No.35184 of 2020(2) dt.23-03-2021 2/3 The petitioner and two others have been named in the F.I.R. on the basis of the stray information provided to the police station that the liquor which was seized belongs to them and that one Guddu Paswan had been the supplier of such liquor.

The learned counsel for the petitioner has submitted that he has no concern with either Rajendra Rai or from anybody who was in any way involved in the trade of liquor.

The petitioner has clean antecedents.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge - II cum - Special Judge, Excise Act, Vaishali at Hajipur,
