JUSTICE ANIL KUMAR SINHA ORAL ORDER 11-03-2022 Heard Mr. Kumar Kamal Nayan, learned counsel for the petitioner and Mr. Md. Mushtaque Alam, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Gangta PS Case No. 22/2017 registered for the offence punishable under Sections 366(A)/34 of the IPC. As per First Information Report, the petitioner abducted the sister of the informant aged about 16 years for the purpose of solemnizing marriage.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of concocted story and, as a matter of fact, the victim girl was in love with the petitioner and her statement was recorded under Section 164 of the CrPC (Annexure-2) wherein she has stated that she/victim girl, out of her own free will, had gone with the

Petitioner is in custody since 30.06.2021 and the chargesheet, in the matter, has been submitted. Regards being to the submissions made by the parties and taking into consideration the statement of the victim girl recorded under Section 164 CrPC, petitioner is in custody since 30.06.2021 and the charge-sheet, in the matter, has been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, MANISH KUMAR @ LANDE be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Munger in connection with Gangta PS Case No. 22/2017.
