Heard learned counsel appearing on behalf of petitioner and learned A.P.P. appearing for the State through video conferencing.

In view of the submissions of the learned counsel appearing on behalf of the petitioner in the second line of paragraph No.1 of this application Criminal Miscellaneous No. 34680 of 2020 be read as "Criminal Miscellaneous No. 34860 of 2020"

This application is filed for modification of order dated 05.04.2021 passed in Criminal Miscellaneous No. 34860 of 2020.

Patna High Court CR. MISC. No.49057 of 2021(2) dt.15-09-2021 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner has been granted pre-arrest bail on 05.04.2021 passed in Criminal Miscellaneous No. 34860 of 2020 with a direction to surrender before the court below within a period of four weeks on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge, Excise, Siwan, in connection with Basantpur P.S. Case No. 110 of 2020, but, due to some unavoidable circumstances, petitioner could not surrender before the Court below within the stipulated time. In such view of the matter, let the time to surrender of the petitioner, as ordered on 05.04.2021 passed in Criminal Miscellaneous No. 34860 of 2020, be further extended by four weeks from today.

Accordingly, the modification application is allowed and the order dated 05.04.2021 passed in Criminal Miscellaneous No. 34860 of 2020 is modified to the above extent.

This application stands disposed of.
