JUSTICE RAJIV ROY ORAL ORDER 02-08-2023 Heard the learned Counsel for the petitioners and Mr. Sanjay Kumar Pandey who represent the State. The petitioners apprehend their arrest in connection with Belchhi P.S. Case No. 14 of 2023 for the offence punishable under Sections 147, 323, 325, 341, 307, 379, 504, 506 of the I.P.C lodged on 14.02.2023 by the informant Balram Kumar.

As per the prosecution story, the two petitioners assaulted the informant's side and specific allegation against the petitioner no. 1 is of having broken the hand of the informant whereas the petitioner no. 2 broke the hand of the informant's father.

Patna High Court CR. MISC. No.41958 of 2023(2) dt.02-08-2023 2/2 It is the case of the learned counsel for the petitioners that there is case and counter case, their case being earlier one. Learned APP opposes the prayer stating that only because the case has been lodged by the petitioners cannot absolve them from the allegation that they have resorted to assaults, causing serious injuries to the informant and his father. Considering the kind allegation that has come against the two petitioners, this is certainly not a fit case for extending the benefit of anticipatory bail.

The petition accordingly stands rejected.
