The petitioner seeks bail in connection with Hajipur Town P.S. Case No. 914 of 2023 instituted for the offence under Sections 394 & 307 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, is that, on 08.11.2023 at about 6:30 PM, while the informant was delivering Flipkart items on his motorcycle, three masked assailants on a Glamour bike intercepted him near Purab Kahtal. One of them pointed a pistol and demanded money, and upon resistance, fired a shot injuring the informant's right leg. The accused then fled with the informant's motorcycle, and the matter was reported to the police.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20-01-2025. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Name of the petitioner has transpired on the basis of his self-confessional statement recorded in connection with Hajipur Sadar PS Case No. 30 of 2024, wherein petitioner allegedly confessed that co-accused Aditya Kumar fired. Recovery is made from co-accused Aditya Kumar. Nothing has been recovered from the possession of the petitioner. Police after completion of investigation has submitted charge sheet in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, manner of petitioner's implication and charge sheet being submitted this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
