The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 448,379,386 and 387/34 of the Indian Penal Code.

The prosecution case is that on the death of Ramdeo Yadav, father in law of Ramnarayan alias Nunu and Rekha Devi being only daughter of Ramdeo Yadav inherited the property but on 23.1.2016 the informant found some tenants have been inducted by Dharmendra Yadav, Surendra Yadav in the inherited house and this petitioner when protest was made then the accused persons snatched jewellery, cash and other articles and assaulted the informant.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.16867 of 2016 (2) dt.21-04-2016 2/2 that the petitioner being agnate of the father in law of the informant is claiming the property by virtue of a will. The petitioner side lodged Rampur P.S. Case No. 138 of 2014 against the informant side and Title Suit No. 322 of 2015 is also pending between the parties.

Considering the nature of accusation levelled in the background of civil proceedings, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Rampur P.S. Case No.20 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
