JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 This application, for grant of anticipatory bail, arises out of Bhagalpur Mahila P.S. Case No. 15/2019, disclosing offences under Sections 313, 376 /34 of the Indian Penal Code. Allegation against the petitioner is of establishing physical relationship with the informant, promising marriage, however, he did not marry her and when she became pregnant, the petitioner got her pregnancy terminated.
Submission of learned counsel for the petitioner is that petitioner is brother-in-law of the brother of the informant and he has falsely been implicated in this case and informant is major and a consenting party in establishing physical relationship and only when the petitioner secured a Job in the University, the informant started pressurizing him for marriage

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Bhagalpur, in connection with Bhagalpur Mahila P.S. Case No. 15/2019, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
