This application has been filed for grant of bail in a case of misuse of bail in connection with Hilsa P.S. Case No. 152 of 2013 registered for the offences punishable under Section 307 of the I.P.C. and Sections, 25(1-B) a, 26 and 27 of the Arms Act. Earlier the petitioner was granted bail by this Court in the aforementioned case vide order dated 24.1.2014 passed in Cr. Misc. No. 52444 of 2013 but subsequently due to nonappearance, the bail bonds of the petitioner were cancelled vide order dated 2.9.2016. The petitioner has subsequently been remanded in the present case from another case on 2.4.2019. It is submitted by learned counsel for the petitioner that the petitioner will appear before the learned Court below regularly.

Considering the fact this is a case of misuse of bail for two and half years and the petitioner has remained in custody for about four months, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Hilsa, Nalanda in connection with S.T. No.530A of 2013 arising out of Hilsa P.S. Case No.152 of 2013.

The learned Court below will be at liberty to cancel the bail bonds of the petitioner in case he defaults on two consecutive occasions.
