2. The petitioner seeks bail in connection with Banka P.S. Case No. 586/2015, registered for the offence under Sections 363 and 364 of the Indian Penal Code.
3. The accused/petitioner is not named in the F.I.R. and is in custody since 07.03.2025.
4. The allegation is regarding the accused persons including this petitioner having abducted the victim boy as per FIR.
5. Learned counsel appearing on behalf of the petitioner submitted that the name of this petitioner was taken by victim boy as recorded
Patna High Court CR. MISC. No.42290 of 2025(4) dt.17-10-2025 2/3 under Section 164 of Cr.P.C. but the main culprit was named as one Binod Yadav and Shanti Yadav, who already granted bail by this Court. It is also submitted by learned counsel that several similarly co-accused persons have already been granted bail by this Court through Cr. Misc. No. 3275 of 2016 dated 16.03.2016 and Cr. Misc. No. 23003 of 2018 dated 20.04.2018. While concluding the argument, it is submitted that investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP opposed the prayer of bail but could not disputed the aforesaid factual submissions as advanced.
7. Considering the aforesaid factual submissions and by taking note of fact as the thrust of allegation is available against co-accused Binod Yadav and Shanti Yadav, coupled with the fact that investigation of this case is already completed, where petitioner remains in custody since 07.03.2025, accordingly, petitioner above
Patna High Court CR. MISC. No.42290 of 2025(4) dt.17-10-2025 3/3 named, is directed to be released on bail in connection with Banka P.S. Case No. 586/2015 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-I-cum-Spl. Judge, SC/ST (POA) Act, Banka/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
