JUSTICE SUDHIR SINGH ORAL ORDER 16-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Begusarai Town P.S. Case No. 674 of 2015 for the offences instituted under Sections 341, 504, 506, 354 and 354(B)/34 of the IPC.

The prosecution story, in brief, is that the informant who was living in a rental house of Md. Jabrail for the educational purpose. On 01.12.2015 at about 6.00 P.M., she came back after purchasing vegetable then petitioner nos. 1 and 2 apprehended her

Patna High Court Cr.Misc. No.15818 of 2016 (2) dt.16-05-2016 2/3 and misbehaved. She raised hulla and after that Md. Nehal and other persons came then they fled away. Petitioner nos. 3 and 4 and some unknown accused persons came armed with weapon at the main gate of the informant and pushed the door, abused to the informant and lady house owner. On hulla, several persons came, then they fled away, giving threatening to kidnap her. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners have falsely been implicated in the present case. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest their implication in the present case. From perusal of Annexure-2, it is evident that the matter has been compromised between the parties.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Begusarai Town P.S. Case No. 674/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to the

Patna High Court Cr.Misc. No.15818 of 2016 (2) dt.16-05-2016 3/3 conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
