2. The petitioner apprehends his arrest in connection with Udwantnagar P.S. Case No. 3 of 2025, registered for the offences punishable under Sections 25(1-B)(a), 26, 35 of the Arms Act.

3. The police, on a tip off concealment of illegal arms ammunition, raided the house of the petitioner. In course of raid, one Shiwji Pandey @ Monu Pandey was apprehended and on whose disclosure two country made pistol along with six cartridges were recovered.

4. Learned Advocate for the petitioner submitted that in fact on the alleged date and time of occurrence, the petitioner was not even present in the house, rather he has been working as a contract worker of EAZYWORLD EHS ENGINEERING

It is further clarified that Golu Kumar is the nick name of the petitioner and his original name as per the school certificate is Chaudhary Vikash and in this regard an Identity Card has been placed on record by filing supplementary affidavit. It is the contention of the petitioner that the person, who was apprehended in the house of the petitioner, was residing for taking care of his ailing parents and the petitioner has no concern with the arms ammunition, which are said to have been recovered from his house; fair antecedent of the petitioner also supports the aforesaid contention.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application.

6. Having considered the submissions set forth by the learned Advocates for the respective parties and taking note of the materials placed through the supplementary affidavit, coupled with the fair antecedent, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial

Case No. 3 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
