JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-05-2015 This is an application for Anticipatory bail in connection with Sultanganj P.S. Case no. 137 of 2014 for offence under sections 323, 307, 341, 504/34 I.P.C. and 3(i)(x)(ii)(iv) of the SC and ST, Act, which was instituted on statement of informant Nirmala Devi, relating to incident dated 25.07.2014 at about 9 P.M.
That prior to this application, the petitioner has not moved either for anticipatory bail or regular bail to this Hon'ble Court.
Allegedly the informant asked her daughter to get the curtain down and as soon as curtain was got down the petitioner started quarreling and assaulted the informant. Further the petitioner and her daughter assaulted her and when the son of
Patna High Court Cr.Misc. No.13959 of 2015 (3) dt.21-05-2015 2/2 the informant went to rescue his mother Gurucharan assaulted him with iron rod resulting in he fell down and became unconscious. Further threatening was given not to lodge the case. Submission is of false implication and that no offence under sectioin 3(i)(x)(ii)(xv) of the SC and ST Act is made out. Further no offence under section 307 I.P.C. is made out and as such the petitioner deserves sympathetic consideration being lady to which the learned A.P.P. opposes.
Considering that it is a fit case for regular bail, the above named petitioner is directed to surrender in the court below and seek regular bail and in that case she shall be enlarged on bail on execution of bail bond to the satisfaction of the learned court below itself and accordingly this application is disposed of.
