The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 332, 353, 354/B, 341, 342 and 186 of the Indian Penal Code and Section 45 of the Bihar Prohibition and Excise Act. As per prosecution case, 4 liters country made chulai liquor was recovered from the shop of the co-accused Ranjita Devi. When the police raided the shop, the petitioner and other co-accused persons attacked the police party and rescued Ranjita Devi.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to village politics. There is

Nothing has been recovered from the conscious possession of the petitioner. The petitioner has got no criminal antecedent as stated in para 3 of the petition. It is further submitted that similarly situated co-accused persons have already been granted bail by other co-ordinate Bench of this Court vide order dated 25.05.2023 passed in Cr. Misc. No. 34611 of 2023 and Cr. Misc. No. 34853 of 2023. Moreover, the petitioner is languishing in judicial custody since 27.04.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Laukariya P.S. Case No. 29 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bagaha, West Champaran.
