JUSTICE SHAILENDRA SINGH ORAL ORDER 16-09-2025 At the outset, Mr. Sanjay Kumar Ojha, learned counsel appearing for the petitioner seeks permission to remove the defect Nos. 28, 67 and 89 in course of the day and he further submits that all these defects can be removed today. It is further submitted by him that the defect No. 110 can be ignored.

2. Considering the aforesaid submissions and prayer made by petitioner's counsel, he is permitted to remove the defect Nos. 28, 67 and 89 in course of the day and the defect No. 110 is hereby ignored.

3. Learned counsel for the petitioner further submits that the instant writ petition has been filed by the petitioner under Article 226 of the Constitution of India, with a prayer for

Patna High Court CWJC No.9964 of 2022(4) dt.16-09-2025 2/2 issuance of appropriate writ/order/direction(s) commanding the respondent authorities to expedite and dispose of the petitioner's Jamabandi Cancellation Appeal No. 29 of 2015, which has been pending before the Collector, Nalanda (respondent No. 2) since 30.06.2015.

4. As per the petitioner's counsel, the said Jamabandi Cancellation Appeal No. 29 of 2015 is still pending. It is very surprising that the Collector, Nalanda (respondent No. 2) is sitting tight on the petitioner's Jamabandi Cancellation Appeal No. 29 of 2015, which was filed in the year 2015 and even after the lapse of ten years, the respondent No. 2 has not taken any steps to decide the same. Accordingly the instant civil writ petition stands disposed of, with giving a direction to the Collector, Nalanda, (respondent No. 2) to decide the petitioner's appeal within six weeks from the date of receipt of the copy of this Court's order or production of the same.

5. It is clarified that the above observation made in this Court's order shall become effective only after the removal of the defects as pointed out by the office.
